Terms governing use of the Quivena website, app, AI features, subscriptions, and related services.
Terms of Service for Quivena
Provider and Contracting Party
The contracting party for use of Quivena is:

These Terms of Service govern the contractual relationship between you and the provider listed above.
Scope of Application
These Terms apply to:
- the Quivena mobile app (iOS),
- the related website at https://quivena.app,
- and all related digital features, content, and services.
Any differing user terms apply only if we explicitly agree to them in text form.
Contract Formation and Acceptance
The user agreement is formed when you use Quivena and accept these Terms.
In the app, a mandatory first-install flow may be shown before regular use, requiring acceptance of these Terms and the Privacy Policy. Without this acceptance, app functionality is not available.
Acceptance may be documented locally on your device and, after sign-in, in your user profile (for example by acceptance timestamps) in order to evidence contractual compliance and legal obligations.
Eligibility (Minimum Age)
Use of Quivena requires that you are at least 18 years old.
By using Quivena, you confirm that you meet this minimum age and are legally capable of entering into a binding agreement.
User Account, Registration, and Security
A user account is required for core functionality. Depending on current feature availability, access methods may include:
- registration with email and password,
- Sign in with Apple,
- and, where available, a limited guest mode.
You are required to:
- provide truthful information during registration,
- keep your credentials confidential,
- protect your account from unauthorized access,
- and promptly notify us of security incidents or suspected misuse.
You are responsible for activities performed through your account to the extent you are responsible for them.
Service Description and Availability
Quivena provides digital functionality for nutrition planning, recipe management, shopping and cooking workflows, and AI-assisted support features.
We continuously develop the service. Features may therefore be added, modified, restricted, or discontinued, provided this is reasonable for users and mandatory legal requirements are respected.
We do not guarantee uninterrupted availability at all times. Maintenance windows, technical failures, external infrastructure issues, or security measures may temporarily limit service availability.
AI-Generated Features Disclaimer
Certain Quivena content may be generated fully or partly by AI systems (for example recipe ideas, variants, or text suggestions).
AI outputs are assistive suggestions and may be incomplete, inaccurate, or unsuitable for your specific situation. You must review results yourself before relying on them.
Quivena may display a "Verified" recipe badge for selected AI recipes after an internal governance process (including cooked evidence, quality thresholds, anti-abuse checks, and moderator review). A verification badge indicates higher confidence in practical cookability under our internal criteria, but it is not a guarantee of personal success, food safety outcomes, health outcomes, legal compliance in your jurisdiction, or suitability for your individual needs.
No claim exists to specific outcomes, specific output quality, or fully error-free AI behavior.
No Medical Advice; Nutrition and Health Disclaimer
Quivena does not provide medical advice, diagnosis, treatment, or disease prevention. Content is provided solely for general informational and organizational purposes.
Use of Quivena does not replace advice from licensed medical, therapeutic, or nutrition professionals. If you have health concerns, allergies, intolerances, medication use, pregnancy, breastfeeding, or chronic conditions, seek qualified professional advice.
You remain solely responsible for food selection, preparation, and consumption.
This also applies to Quivena’s saved ingredient-only diet feature. Generated diets are planning aids that list ingredients and quantities only; they are not prescriptions, treatment plans, or clinician-approved meal protocols. If Quivena blocks, limits, or flags a diet for repair because of a higher-risk health context, you are responsible for following qualified professional guidance before relying on that output.
This also applies to Nutrition Intelligence detail pages, dynamic recommendations, and scientific fact cards. These features are informational support for self-management and do not constitute individualized clinical nutrition or medical treatment.
Alcohol-Related Features and Safety Restrictions
Quivena may include both non-alcoholic and alcoholic cocktail-related features. Additional age and safety rules apply to alcoholic functionality.
We may technically block requests, especially where:
- required age information is missing,
- legal age thresholds are not met,
- or risky prompts are detected (e.g., intoxication optimization, dangerous substance-mixing requests).
Technical age logic may be region-dependent (currently, for example, USA 21+, otherwise 18+ for alcoholic suggestions).
Important note: alcohol strength/effect estimates are guidance only and are not medical or legal guarantees.
AI-generated output may contain inaccuracies, omissions, or unsuitable recommendations. You must verify ingredients, quantities, allergens, and preparation steps before use. In-app AI generation may require a one-time explicit acknowledgement of this risk notice; without acknowledgement, AI generation functionality may be restricted.
User Content (UGC) and License Grant
If you submit content (for example community recipes, images, comments, titles, or descriptions), you generally retain ownership of your content rights.
However, you grant us a non-exclusive, worldwide, royalty-free license to use that content as required to provide and operate Quivena, including the right to:
- store,
- reproduce,
- process,
- display,
- publish within the service,
- and technically transmit to recipients you initiate (for example share features).
This can include shared recipe, collection, or shopping-list pages that become viewable to anyone with the corresponding link/code until the share is revoked or otherwise restricted by the feature design.
This license is limited to what is necessary to provide and operate the service and generally ends when content is permanently removed, subject to legal retention obligations and technical backup cycles.
You represent that you hold all required rights and that your content does not infringe third-party rights.
Acceptable Use and Prohibited Conduct
You may use Quivena only in compliance with applicable law and these Terms.
The following are prohibited in particular:
- abusive, fraudulent, or unlawful use,
- circumvention of technical safeguards,
- automated mass scraping, reverse engineering beyond mandatory legal allowances, or disruption of infrastructure,
- uploading or distributing unlawful, insulting, discriminatory, violent, pornographic, or otherwise impermissible content,
- infringement of copyright, trademark, personality, or other third-party rights,
- and use for creating or distributing harmful instructions.
Enforcement, Warnings, Suspension, and Termination
In case of violations, we may apply proportionate enforcement measures. Depending on severity, frequency, and risk, this may include:
- notice or warning,
- temporary feature limitation,
- temporary account suspension,
- permanent deactivation/termination of the account.
For severe violations, acute security risk, or legal necessity, immediate action may be taken without prior warning.
Fees, Plans, and Billing
Quivena is offered in a freemium model. A free Starter experience is available for core planning, shopping, prep, and cooking workflows. Paid plans (for example Plus/Family) may unlock additional AI-related functionality and higher usage limits.
Access to specific premium features may require an active subscription, while core features may remain available without paid subscription. Available features can vary by time, region, platform, and product version.
For AI-enabled paid tiers, Quivena may enforce monthly token limits for included server-paid AI usage. Any recipe-generation counts shown in-app or on pricing pages are estimates derived from typical token usage and are not guaranteed fixed output amounts.
For eligible paid tiers, Quivena may offer one-time purchasable AI token packs as consumable in-app purchases. Purchased pack tokens are added to your available server-paid AI usage and remain available until consumed (they do not reset monthly by default).
Quivena may also offer limited starter promo campaigns that grant non-purchased promotional AI tokens subject to campaign-specific rules (for example verification requirements, one-time claim limits, feature restrictions, availability windows, and anti-abuse checks). Promotional tokens are optional, can be changed, paused, denied, or discontinued for future claims, and are separate from purchased token packs or subscription entitlements.
Where paid functionality is offered as in-app purchase or subscription, payment handling is generally processed by the Apple App Store under Apple’s billing and contract framework.
Pricing, renewal, cancellation, billing, and refund handling are governed by the terms shown in the App Store. We may adjust free/paid feature scope going forward.
Consumer Rights, Withdrawal, and Cancellation
If paid digital services are offered, applicable statutory consumer rights remain in force.
Where billing is processed through the Apple App Store, subscription management, cancellation, and refund workflows are generally handled through your Apple account and Apple-provided processes.
Any mandatory statutory rights (especially mandatory consumer protections) remain unaffected.
Bring Your Own AI API Keys (BYO Keys)
Quivena may optionally allow users to connect their own API keys for supported AI providers.
If you use your own keys, you are solely responsible for:
- lawful use of those keys,
- compliance with the third-party provider’s terms,
- and all related costs, limits, and availability risks.
Any claim regarding third-party AI provider performance or outages is subject only to applicable law and these Terms.
Third-Party Services and External Links
To provide the service, third-party providers may be used, including for:
- hosting and infrastructure,
- authentication,
- app distribution,
- analytics,
- and AI-related functionality.
This may include services from Apple, Google/Firebase, OpenAI, or Microsoft. For external links and third-party offerings, the respective provider’s terms and privacy notices also apply.
Intellectual Property Rights
All rights in Quivena, including software, design, trademarks, database structures, text, and other protected content, are owned by us or our licensors.
You receive a simple, revocable, non-transferable right to use the provided features for contractual private use.
Any further use, reproduction, distribution, public communication, or modification is prohibited without prior express permission unless mandatory law allows otherwise.
Warranty and Liability
Statutory law applies unless otherwise stated below.
We are fully liable:
- in cases of intent and gross negligence,
- for injury to life, body, or health,
- under mandatory product liability law,
- and to the extent of expressly assumed guarantees.
In cases of slight negligence regarding essential contractual obligations (cardinal obligations), liability is limited to typical, foreseeable damage.
In all other cases, liability for slight negligence is excluded to the extent permitted by law.
These liability rules also apply in favor of our legal representatives, employees, and vicarious agents.
Term, Suspension, and Contract End
The user agreement runs for an indefinite period. You may terminate use at any time by stopping use and, where desired, requesting account deletion.
You can initiate account deletion directly in the App (Settings -> Account Actions -> Delete account). If needed, you can also request deletion by email to mail@quivena.app. Data deletion details are governed by the Privacy Policy.
Either party’s right to extraordinary termination for good cause remains unaffected.
Changes to These Terms
We may update these Terms for future effect where there is a valid reason, including:
- legal changes,
- service evolution,
- introduction of new features,
- or technical/organizational changes.
Material changes will be announced appropriately (for example in-app or on the website).
Governing Law and Venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer habitually residing in another country, mandatory consumer protection provisions of that country remain unaffected.
Where a venue can be validly agreed, venue is at the provider’s registered location. Statutory jurisdiction rules for consumers remain unaffected.
Language Clause
These Terms are provided in German and English.
In case of conflict, interpretation uncertainty, or deviation between language versions, the German version prevails to the extent legally permitted.
